Right to Refuse Service

Our services are provided contingent upon the approval of your application and receipt of payment. We retain the right to decline service to any individual or organization at our discretion, without needing to provide a justification. Additionally, we reserve the right to modify or discontinue any part of our services at any time, provided we fulfill any prior commitments made to you following the acceptance of your payment.


Refund and Cancellation Policy

When booking a retreat, a non-refundable deposit of 300€ is included in your payment.

If your application is declined due to health-related concerns or at our discretion, you will receive a partial refund, which is the total amount paid minus a 40€ administrative fee.

Should you choose to withdraw your application and cancel your reservation for any reason, the deposit will remain non-refundable.

Cancellation and Refund Policy

If you are unable to attend the retreat you have booked, we offer the following options based on the time of your cancellation:

Your retreat fee includes a €300 non-refundable deposit which covers application processing and administrative fees. In case of any questions, please reach out to contact@kiyumi.org. Our office team will be of assistance.

Should you wish to cancel your participation on the retreat dates that you booked, we offer the following options:

  • Cancellation 60 days before the retreat start date entitles you to a 75% refund of your registration fee, excluding the non-refundable deposit.
  • Cancellation up to 30 days before the start of the retreat, you will receive a 50% refund of your registration fee minus the non-refundable deposit.
  • Cancellation up to 14 days before the start of the retreat, you will receive a 25% refund of your registration fee minus the non-refundable deposit.
  • No refund will be issued for cancellation within 14 days before the start of the retreat.

If you are paying in installments and need to cancel for any reason after the deadline, then your full payment is still due in the previously agreed upon dates.

COVID-19 Policy

We adhere to the national COVID-19 regulations of the country hosting the retreat, whether in Spain or the Netherlands. If any conflict arises between our policy and local regulations, the national guidelines of the retreat location will take precedence.

Current Guidelines (as of 21 March 2022)

  • Health and Well-being:
    Please travel only if you are in good health. If you experience any symptoms of illness, we kindly request that you prioritize your health and the safety of others by staying home.
  • Preparation Before Arrival:
    To minimize the risk of infection, we encourage participants to limit social interactions in the days leading up to the retreat. Use this time for personal reflection and preparation for your retreat experience.
  • Travel Requirements:
    If you are traveling internationally, ensure you meet the entry requirements of the retreat’s host country. Our retreat centers are unable to provide quarantine accommodations. Any necessary self-quarantine must be arranged independently before the retreat begins.
  • On-site Safety Measures:
    A negative COVID-19 rapid test result is required on the first day of the retreat before entering the venue.

Policy Updates

Our COVID-19 policy is subject to revision based on new information, ethical considerations, or updates to national regulations in the host country. Any changes will be communicated promptly to ensure the health and safety of all participants.

Retreat Cancellation

In the unlikely event that Kiyumi needs to cancel a retreat, you will have the option to transfer your booking to a similar retreat of your choice or have your retreat fee stored as credit for a future retreat.

Changes to Terms

We reserve the right to amend these Terms and Conditions at any time. Any changes will take effect immediately upon notification, which may be provided by posting the updated Terms and Conditions on our website, www.kiyumi.org. Continued use of our website or services following such notification constitutes your acceptance of the changes.

We may also update any part of our website or services, including these Terms and Conditions, at any time. The most current version will always be available on the website, with the effective date clearly indicated on this page.

Limitation of Liability

You agree that under no circumstances shall Kiyumi be liable for any direct, indirect, incidental, consequential, special, punitive, exemplary, or other damages arising from your use of the website or our services. Furthermore, Kiyumi shall not be held responsible for damages related to:

  1. System or Service Failures: Any performance failure, error, omission, denial of service, interruption, deletion, defect, delay in operation or transmission, computer virus, or line or system failure.
  2. Losses: Any loss of revenue, anticipated profits, business opportunities, savings, goodwill, or data.
  3. Third-Party Actions: Any theft, destruction, unauthorized access to, alteration of, or use of your information or property by third parties.

This applies regardless of negligence, gross negligence, failure of an essential purpose, or any other legal theory, even if Kiyumi has been advised of the possibility of such damages or could have foreseen them.

In jurisdictions where exclusion or limitation of liability is not permitted, Kiyumi’s liability is limited to the fullest extent allowed by law. In no event shall Kiyumi’s total cumulative liability exceed the total purchase price of the services you have bought from us. If no purchase has been made, Kiyumi’s total cumulative liability shall not exceed €100.

Third-Party Resources

The website and emails from Kiyumi may include links to third-party websites and resources. You acknowledge and agree that Kiyumi is not responsible for the availability, accuracy, content, or policies of these external websites or resources. The inclusion of such links does not imply any endorsement or affiliation with Kiyumi. You assume full responsibility and all risks associated with your use of any third-party websites or resources.

Dispute Resolution

If you have any concerns or disputes regarding the service, you agree to first attempt to resolve the issue informally by contacting Kiyumi.


Indemnification

You agree to indemnify and hold Kiyumi harmless from any and all losses, damages, liabilities, settlements, costs, charges, assessments, expenses, and third-party claims, including but not limited to attorney’s fees, arising from your breach of these Terms and Conditions or your use of the website or services.

You also agree to provide Kiyumi with reasonable assistance, at no charge, as we may require in connection with any defense, including but not limited to providing relevant information, documents, records, and reasonable access to you. You may not settle any third-party claim or waive any defense without obtaining Kiyumi’s prior written consent.


Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. In such a case, the parties agree to work together to replace the invalid provision with one that closely aligns with the intended economic and legal purpose of the original provision.
